What is a Party Wall

A party wall is a wall that stands along the boundary of land between at least two different ownerships. This definition covers walls that run along the boundary between two gardens and shared walls between semi-detached and terraced houses .

Walls the stand on land within a single ownership, but are used by at least two owners to separate their properties, will fall under the Party Wall Act.

If you need to use a party wall as a structural component of your new construction, underpin it or build foundations in close proximity to it, it is likely that a Party Wall Agreement or Party Wall Award will be needed.

The Party Wall Agreement Process

If you and your neighbour are in general agreement about the planned works at the outset, a Party Wall Agreement may be good choice.

  • You first serve Party Wall Notice to your neighbour before drafting a Party Wall Agreement. This will be accompanied by a description and a set of drawings detailing the proposed building work.
  • The Party Wall Agreement is a signed document drafted by one (or both) of the property owners involved, describing the work that is to be carried out and detailing any special conditions dictated by either party.
  • A Party Wall Agreement is usually coupled with a Schedule of Condition. This is a written document describing the current state of the boundary or wall, usually accompanied by relevant photographs.

If correctly drafted and signed by both parties, the Agreement and Schedule of Condition would stand up in court in the event of an ensuing dispute.

What Does a Party Wall Award Involve?

If your neighbour dissents to your Party Wall Notice and refuses to enter into a Party Wall Agreement, a Party Wall Award must be prepared by one or more Party Wall Surveyors. Under the Party Wall Act, the person proposing the construction works is liable for the payment of party wall surveyors appointed by their neighbours. The Party Wall Surveyor or Surveyors will then find solutions to the problems which led to the disagreement and prepare the legally binding Party Wall Award.
